ARTICLES OF AGREEMENT*

BETWEEN WHALESHIPS
IN THE GALAPAGOS ISLANDS
1801

1st  The ship which Discovers a School of Whales will immediately hoist his Ensign to the Miz.Topmast head ...
 
2nd  If in a School of Whales our Lines get foul of each other we will use every endeavour to clear them and Not cut each Other's lines without Mutual Consent.
 
3rd  If a boat is in Danger of losing her line the Nearest Boat is to Give his and without any Exception or Claim whatever.
 
4th  If a boat Strikes a Whale & parts & then Strikes another, the first whale so Struck becomes the property of Any Boats who shall kill her; but must Return the Craft (harpoon). Yet, if the first boat is following his whale & hath not been fast to another he Claims the whale, even though she is killed by Another Ship's boat.
 
5th  If a ship falls in with Dead whales not having any Craft in them, a Union Jack will be hoisted for the benefit of those to whom they may belong.
 
6th  If only a Single whale is in sight no signal will be Made & if more than one Ship's boats are after her tis agreed to render the Fast boat every assistance, & should any Damage be Sustained in Consequence, it will be Made Good by the ship who takes the Whale.
 
7th  If Ships be in want of assistance in the Night, a tryangular Light will denote it where best to be seen. Every other Ship who sees it will Render her Every assistance they Conveniently can.
 
8th  If any Dispute should occur respecting the Claim of a whale or whales, such Disputants shall Chuse two Disinterested Masters, the two to Choseth to Apoint a Third. The award of eather Two Shall be conclusive.
 
9th  In case of falling in with a Stoven Boat tis agreed to Render her all Convenient assistance it being the intent of our present Resolves to promote our Mutual Interest and preserve Amity.
 
10th  It is further Agreed that each Commander will Make Known the Intent of our Present Regulations in order that no Collusion may herafter ensue.
